NOTICE REGARDING TELEPHONIC PARTICIPATION IN
 THE HEARING SCHEDULED FOR OCTOBER 7, 2009 AT 11:00 A.M. (EST)

PLEASE TAKE NOTICE that the Honorable Martin Glenn, United States Bankruptcy Judge, has authorized counsel and parties appearing in this case to attend telephonically via Tele-Court in the hearing to be held before the Court on October 7, 2009 at 11:00 a.m. (the “Confirmation Hearing”) concerning:
 
(i) the approval of the Second Amended Plan (Chapter 11) of Reorganization of Gerard A. McHale, Jr., as Chapter 11 Trustee for Each of the 1031 Debtors, and IPofA Shreveport Industrial Park, LLC and
 
(ii) the Chapter 11 Trustee and IPofA Shreveport Industrial Park, LLC’s Motion and Memorandum of Law of the Chapter 11 Trustee for Entry of an Order Pursuant to Sections 105(a) and 363 of the Bankruptcy Code and Rule 9019(a) of the Federal Rules of Bankruptcy Procedure Approving Plan Funding Party Settlement
 
Agreements subject to compliance with the Tele-Court procedures provided on Exhibit 1.
 
Reservations for telephonic participation should be made with Tele-Court no later than October 6, 2009 at 4:30 pm by the procedures provided in Exhibit 1.
 
PLEASE TAKE FURTHER NOTICE that counsel and parties appearing at the Confirmation Hearing, whether in person or by telephone, should be present in the Courtroom or on the telephone by no later than 10:45 a.m. (EST) to make his or her appearance on the record, identifying counsel’s name and each of the parties on whose behalf counsel is appearing, so that the hearing may commence promptly at 11:00 a.m. (EST).

Procedures to Use Tele-Court

If parties wish to appear by telephone, they must call (800) 924-5680 or go to www.tele-court.com and make their own arrangements to do so.  There will be no charge for this service.  If you choose to make arrangements via the website, you need to select “open account”.   When you are asked for payment information, you need to select “demo” so you are not charged.  Unless the registering party is counsel who may make arguments at the Confirmation Hearing, each registrant must register as “listen only”.  

Each participant that makes arrangements with Tele-Court to appear telephonically will receive a dial in number and a unique PIN.  Each PIN permits the entrance of only one person to the telephone conference, so PINs cannot be shared.  When the hearing commences, the Honorable Martin Glenn, who will be assigned a PIN, will call in and join all telephonically appearing parties into the hearing.
 
It is our understanding that there will be a video feed of the hearing available at tele-court.com.  Flash Player 9 or later will be required to view the conference.
